Case No. SKA-14/2022 (A420186017) concerns a dispute over compensation payments for restrictions on economic activity in a Natura 2000 protected nature area of European significance.
The Rural Support Service refused to grant the applicant compensation for a restriction on economic activity – the prohibition of growing cranberries in the bogs owned by the applicant, which are part of a Natura 2000 area, because the regulatory acts do not provide for compensation for the prohibition of establishing cranberry plantations in bogs.
The Senate found that national legislation only provides for compensation for Natura 2000 forest areas, excluding bogs from them, and that compensation is only provided for forestry restrictions imposed in these areas.
